Part Lot Control Exemption is another form of land division in addition to Plans of Subdivision and Consents. Section 50 of the Planning Act allows a municipality to pass a by-law that excludes lands within a Registered Plan of Subdivision from the Planning Act 's Part Lot Control regulations. This allows a land owner to divide parts of land for sale, conveyance, lease or mortgage.

A good example of how the Part Lot Control Exemption is used is the division of semi-detached and street townhouse units. Applications for this exemption are usually submitted after construction begins and the building foundations are approved. This makes it is easier to determine accurate property boundaries between units.

An approved Part Lot Control Exemption By-law is in place for two years. After that, the by-law expires and the Part Lot Control regulations of the Planning Act come back into effect.

How to Apply

Part Lot Control Exemption Application Process

Please note that all applications submitted after January 1, 2024 are subject to Tariff of Fees By-Law 94-23. Please contact the Development Planning Division at planning@richmondhill.ca for confirmation of applicable fees.

  1. NEW: The City receives a completed Part Lot Control Exemption online application form, including the required information and fee(s). As part of the Part Lot Control Exemption online submission (step 5 “Attachments”), the Authorization of Registered Owner(s) must be complete. 
    1. Part Lot Control Exemption Application [Online fillable form]
  2. Once the application is deemed complete, the Development Planning Division circulates your application to City departments and applicable external agencies for review and comment.
  3. If there are no comments and/or objections to the proposed exemption, Departmental clearances are issued including registration restrictions.
  4. The Development Planning Division prepares a by-law for Council's consideration.
  5. At a Council Meeting, Council adopts the Part Lot Control Exemption By-law with a two-year expiry date.
  6. The Part Lot Control Exemption By-law is registered on title of the property and all land transactions are finalized.
  7. After the two-year expiration date, Part Lot Control is in effect for the property.
